All rentals are subject to availability.

General Terms and Conditions for Equipment and Vehicle Rentals:

1) Rental period required: MONTH TO MONTH. Rentals can be renewed at Westwind's consent and based on renter's payment performance. 

2) Rental rate is the above quoted amount + TAX per month. Monthly rental rate is for 180 hours per month only. Additional hours will result in an adjusted rental fee. If mechanical difficulties cause a work stoppage, an adjustment in favor or the lessee will be made. 

3) The rental begins on the date of delivery and continues on an uninterrupted basis until date of return (picked-up).

4) There is a transportation cost for each machine/vehicle delivered and picked-up. Transportation costs are calculated for each direction of service.

5) Lessee agrees to carry all risk insurance on the equipment in the amount designated by Westwind and to assign loss of payments to Westwind Contracting, Inc.

6) During the term of the lease, Lessee agrees, at its own cost and expense, to operate and maintain the equipment with factory authorized parts and to make any repairs which may become necessary. Lessee agrees to return the equipment to Lesser in the same condition as received, normal wear expected. Lesser reserves the right to inspect the equipment upon return for established defects and Lessee agrees to pay the cost of remedying any such defects, including any tire damage. 

7) The Standard Manufacturers' Warranty constitutes the sole warranty and remedy with respect to the aforementioned machinery.

8) Lessee agrees that he will not remove the equipment from the State of Florida.

9) Lessee agrees that he will not sublease equipment without expressed written consent of the Lesser.

10) Lessee agrees that he will not subject the equipment to any lien, encumbrance or claim of any kind other than this lease agreement.

11) In the event that it should become necessary to bring any action or proceeding to enforce this agreement, and Lesser is adjudged to be the prevailing party, Lesser shall be entitled to recover its costs and reasonable attorney's fees (both at trial and on appeal).
